Amendment in Encashment of Leave Preparatory to Retirement Punjab

Government of the Punjab, Finance Department has issued a Notification on 12-03-2021 in connection with Amendment in Encashment of Leave Preparatory to Retirement Punjab. The details are as under:

Amendment in Encashment of Leave Preparatory to Retirement Punjab

In exercise of the powers conferred under Section 23 of the Punjab Civil Servants Act, 1974 (VIII of 1974), the Governor of Punjab is pleased to make the following amendments in the Revised Leave Rules, 1981 with immediate effect:

In the Revised Leave Rules, 1981:

  • In rule 17:
  • Heading, the word “refused” shall be omitted:
  • In sub-rule (1), the words “for the leave refused to him” shall be omitted;
  • In sub-rule (2), the words “refused partly and” and” of such leave so refused” shall be omitted;
  • Sub-rule (3), words “in lieu of such refused LPR” and “for the period of leave so refused” shall be omitted; and
  • After -rule 36, the following shall be inserted:

“37. Relaxation of Rules.- The chief Minister may relax any of the rules on the basis of the reasons beyond the control of a civil servant”.

New Corm of the Leave Encashment Rules Punjab

  1. If, in case of retirement on superannuation *(or voluntary retirement on completion of twenty-six years qualifying service) a civil servant cannot, for reasons of public service be granted leave preparatory to retirement duly applied for insufficient time, he will in lieu thereof, be granted lump-sum leave pay subject to a maximum of three hundred and sixty-five days to leave on full pay.
  2. Such leave can be sanctioned partly but the cash compensation shall be admissible for the actual period not exceeding three hundred and sixty-five days.
  3. The payment of leave pay may be made to the civil servant either in lump-sum at the time of retirement or may, at his option be drawn by him month-wise.
  4. For the purpose of lump-sum payment in lieu of such refused leave, only the “Senior Post Allowance” will be included in “Leave Pay” so admissible.
  5. In case a civil servant on leave preparatory to retirement dies before completing three hundred and sixty-five days of such leave, his family shall be entitled to a lump-sum payment equal to the period falling short of three hundred and sixty-five days.
