Punjab Service Tribunal, Lahore has issued the order sheet (Judgement) on 12th February 2021 in connection with English Teacher Regularization from the date of joining 2021.

Appellant filed instant appeal under section 4 of the Punjab Service Tribunal Act, 1974 with the following prayer:
“In view of the above mentioned submissions and foregoing reasons it is most respectfully prayed that the instant appeal may kindly be accepted and impugned orders passed by the respondents may very graciously be set aside and the directions may kindly be issued to the respondents to award selection grade to the appellant, with all consequential benefits – without any stigma, for the sake of justice, equity and fair-play”
I have considered the arguments of both parties and perused the record.
A perusal of record reveals that the appellant was appointed as Graduate Primary Teacher on 2.9.1995 in Education Department. Thereafter, services of the appellant along with other colleagues were regularized by the S&GA Department (Regulation Wing), Government of the Punjab, Lahore vide order dated 28.7.2004. as well as an order dated 23.12.2004, the DEO (EE-M), Khanewal also passed an order dated 22.6.2005 for regularization of appellants along with his colleagues w.e.f. the date of their initial appointment.
According to notification of the Government of Punjab, the Graduate English Teachers will be treated as regular employees from the date of their joining subject to fulfillment of prescribed professional qualification. They will be entitled to all service benefits as well as financial benefits available to civil servants.
Furthermore, the Graduate English Teachers were eligible and entitled for the award of selection grade from September 1995 under the Govt. of the Punjab, Finance Department’s notification dated 16.5.1977 as per Rule 8(3) of the Punjab Civil Servants Pay Revision Rules, 1977, which is reproduced as under:
“Where the class of posts, apart from ordinary pay scale, a higher pay scale has been provided for the percentage of the numbers of said posts, i.e. selection grade, the higher pay scale shall be admissible to holders of the posts in BPS-1 to BPS-16 after minimum length of service of 02 years in the ordinary pay scale of the posts. In the case of employees of BPS-17 and above, a minimum length of service of 05 years in the ordinary pay scale of the posts in necessary. The higher pay scale shall be allowed on seniority cum fitness basis on the recommendations of the appropriate departmental promotion committee or board”.
The award of selection grade was discontinued by the Statistical Officer (FC), Finance Department, Govt. of the Punjab, Lahore vide letter dated 3.11.2001 but the said letter was not applicable on the appellant because appellant’s Services were regularized vide order dated 22.6.2005 from the date of his initial appointment i.e. 2.9.1995.
In view of what has been discussed above, the instant appeal is disposed of with the direction to the department concerned to award selection grade to the appellant.
